Course Aim
For the first time in Irish law, there is a Bill which provides comprehensive guidance to the Courts on what considerations to take into account when making a determination on the child’s best interests. This will provide much-needed guidance for the judiciary and will promote consistent application across the country. The guidance set out in the Bill is in line with Article 3 of the UN Convention on the Rights of the Child.The Bill provides a comprehensive definition of the ‘best interests’ principle, and provides that the best interests of the child will be paramount in any decisions on guardianship, custody or upbringing of, or access to, a child (Section 41(3)(1)). It is a ground breaking Bill and will make Ireland a world leader in this area. This course will provide the learner with a simple but comprehensive understanding of this Bill and the implications of this within the home and workplace Who should apply? Anyone who is working with or caring for children on a professional or private basis.
